Romania: partial e-invoicing for B2B fiscal products

Since the start of 2022, there have been some significant developments in the e-invoicing landscape in Romania. Tungsten Network has been assisting suppliers and buyers in Romania and we have been monitoring these changes closely, what this means for our solution and how we can help our customers.

In January 2022, the Romanian Tax Authority, the Agentia Nationala de Administrare Fiscala (ANAF) announced a partial e-invoicing mandate relating to B2B fiscal products. The Romanian tax authorities will require high tax-risk products to be reported to the Romanian e-invoicing platform, the RO e-Factura. This becomes mandatory on 1st July 2022. The partial e-invoicing mandate means that only high-risk fiscal products are required to be cleared via the RO e-Factura. It also means that Romania will not yet require approval via a derogation from the European Union to implement this mandate.

Products that come under the definition of a high-risk fiscal product are defined on the ANAF website and the list can be regularly updated.

Currently, Tungsten Network can create the legal invoice on behalf of our suppliers in Romania. The upcoming partial mandate means that from 1st July 2022, suppliers transacting with high-risk fiscal products must obtain the legal invoice, which has been digitally signed, via the RO e-Factura. Tungsten Network is not connected to the RO e-Factura. This means that Tungsten cannot create the legal invoice on behalf of suppliers who are subject to the mandate from 1st July 2022.

Tungsten will however continue to support its suppliers and buyers in Romania. We have been analysing how we can best serve our customers considering these changes.

Helping our Web Form suppliers in Romania

Romanian Web Form suppliers will be prompted to confirm whether they are using Tungsten Network to transact with high-risk fiscal products when they first use our portal.
• If suppliers are subject to the mandate: Tungsten Network will no longer create the legal invoice from 1st July 2022 and suppliers must attach the cleared and digitally signed XML to our system. Tungsten Network will create a PDF image that will clearly state “this is not a tax invoice” and send this, along with the buyer data file, to the buyer.
• If suppliers are not subject to the mandate: Tungsten will continue to produce the legal invoice on behalf of the supplier.

Helping our Integrated suppliers in Romania

Romanian Integrated suppliers have already been contacted by Tungsten Network Support to confirm if they transact with high-risk fiscal products using Tungsten Network.
• If suppliers are subject to the mandate: Tungsten will no longer create the legal invoice from 1st July 2022 and suppliers must attach the cleared and digitally signed XML to our system. Tungsten Network will create a PDF image that will clearly state “this is not a tax invoice” and send this, along with the buyer data file, to the buyer. The supplier profile will be configured to receiving the attachment.
• If suppliers are not subject to the mandate: Tungsten will continue to produce the legal invoice on behalf of the supplier.

Helping our buyers in Romania

We can deliver the legal invoice which has been digitally signed by the RO e-Factura to our buyers, along with the PDF image with the buyer data file. The PDF image will clearly state that this is not a tax invoice.
